PLEASE READ CAREFULLY BEFORE BIDDING

By placing a bid, you acknowledge and agree to the following:

Buyer Declaration

• I have read and accept these Terms and Conditions in full.
• I understand that all vehicles are sold AS SEEN, WITH ALL FAULTS, AS DISPLAYED AT THE TIME OF SALE and WITHOUT ANY WARRANTY OR GUARANTEE, except where expressly provided in writing or required by law.
• I understand that vehicle descriptions, photographs, condition reports, mileage readings, MOT information and service history are provided for guidance only, may contain errors or omissions and do not form part of the contract of sale.
• I acknowledge that it is my responsibility to verify the vehicle specification, documentation and condition before bidding.
• I acknowledge that I have been given a reasonable opportunity to inspect the vehicle before bidding and, if I choose not to inspect it, I do so entirely at my own risk.
• I understand that no guarantee is given regarding the mechanical, electrical, structural or cosmetic condition of any vehicle.
• I acknowledge that mileage shown is the odometer reading only and is not warranted unless specifically stated as warranted in writing by the seller.
• I understand that vehicles may require repair, servicing or preparation before being used or resold.
• I understand that a legally binding contract is formed when the Auctioneer accepts my bid at the fall of the hammer and I am committed to completing the purchase.
• I agree to pay the purchase price together with the buyer's premium, VAT (where applicable) and any other applicable charges within the timescales set out in the Auction Terms and Conditions.
• I understand that risk in the vehicle passes to me on completion of the sale and that ownership of the vehicle will not pass until all monies due have been received in cleared funds.
• I agree to collect the vehicle within the stated collection period. Failure to do so may result in storage charges and/or cancellation fees.
• I acknowledge that all sales are final and that vehicles cannot be rejected or returned due to faults, defects, wear and tear or buyer dissatisfaction, except where required by law.
• I understand that bidding online without physically inspecting the vehicle is entirely at my own risk and I accept the vehicle based on my own assessment of the information provided.

Online Bidding

• Newark Motor Auctions accepts no responsibility for interruptions to internet services, delays in transmission, software failures, hardware failures or any other technical issues which may prevent, interrupt or delay bidding.
• Newark Motor Auctions reserves the right to withdraw any vehicle from sale or refuse, cancel or re-offer bids where necessary.

Important Notice

By proceeding, you confirm that you have had the opportunity to inspect the vehicle or obtain independent advice before bidding.

To the fullest extent permitted by law, the Seller excludes all warranties and guarantees not expressly given in writing.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

Privacy Notice

By accepting these Terms, you acknowledge that Newark Motor Auctions will process your personal data, including your IP address and bidding information, in accordance with its Privacy Notice for the purposes of administering the auction, preventing fraud and complying with legal obligations.

Acceptance

You understand that by accepting these terms and placing a bid, you are entering into a legally binding agreement to purchase the vehicle if you are the successful bidder.
